Meta may use sweeping new commercial TOS to avoid millions in AI licensing fees
After backlash, Meta removed language from its commercial terms page suggesting it could use content from sites associated with its business users to train its AI. The terms, due to take effect October 30th, had led Nieman Lab and legal experts to warn Meta could argue they supersede blocking instructions like robots.txt, while spokesperson Daniel Roberts said the company was just consolidating its ad terms.

Websites are closing their doors to AI agents
In recent weeks, users of Meta's Muse, xAI's Grok, OpenAI's Dots, and Instinct have reported blocks stopping their AI agents from performing tasks on top websites. Yelp told TechCrunch it only allows AI agents that pay for its data licensing program, while Delta Air Lines is preventing them from booking tickets.
If your design has browsing agents handle bookings or purchases, per-site blocks and paid data-licensing requirements can make those tasks fail, so you need official API or licensed routes as a fallback and explicit failure handling.
